Accident without fault
Where the other side is fully liable, necessary legal fees are generally recoverable as part of the loss. Recovery may be limited where liability is shared. It would therefore be inaccurate to promise that legal assistance is automatically free after every accident.
Fine and criminal proceedings
Separate fees arise and depend on the work and stage of proceedings. German statutory fees under the Lawyers’ Remuneration Act or a fee agreement may apply. The initial work and fee basis should be clarified before instruction.
Legal expenses insurance
Cover depends on the policy, insured risk, waiting periods, excess, exclusions and confirmation of cover. A positive coverage decision does not determine the legal merits of the case.
What helps with a cost assessment?
Provide the type of matter, current procedural stage, relevant correspondence and, where applicable, the policy or insurance number and excess. The firm will explain which further documents are needed. Existing deadlines should always be identified separately and as early as possible.
Economic assessment
Where a claim is disputed, the likely benefit, available evidence and cost risk should be considered together. A reliable consultation addresses not only legal possibilities but also their economic consequences.
