Regulatory traffic proceedings
Review the penalty notice before deciding.
The objection period against a German penalty notice is generally two weeks from service.
Keep the envelope and every page because the actual date of service matters. Sending an enquiry does not preserve the deadline; deadline monitoring begins only after the firm expressly accepts the mandate.
Before a penalty notice arrives
A hearing form should not be answered hastily. Mandatory personal particulars must be distinguished from a statement about the allegation. A premature account can make a later defence more difficult.
What may be reviewed?
Typical allegations concern speed, red lights, distance, mobile-phone use and driver identification. The examination may include photographs, witness evidence, measurement records, tolerances and the legal consequences of points or a driving ban.
Inspection of the file
A reliable assessment often becomes possible only after access to the authority’s file. The available evidence can then be compared with the allegation before deciding whether an objection should be pursued and what response is appropriate.
Points, driving ban and professional consequences
The fine is not always the only relevant consequence. Points and a potential driving ban may be particularly important for professional drivers or anyone dependent on a vehicle. Professional hardship does not automatically remove a ban and must be documented concretely.
