Do not make a premature statement

An accused person does not have to incriminate themselves. Personal particulars and other statutory duties must be distinguished from a statement about the allegation. A police summons does not generally require an accused person to provide a statement without prior legal review.

Typical proceedings

Leaving the sceneAccident involvement, perception, waiting duties and later conduct.
Alcohol or drugsMeasurements, observations, blood samples and licence consequences.
Dangerous drivingDriving conduct, a concrete danger, evidence and intent or negligence.
Driving without a licenceExisting entitlement, effective bans and knowledge of the circumstances.

The driving licence may be affected early

In addition to a fine or sentence, a driving ban, withdrawal of the licence and a disqualification period may be considered. In certain proceedings the licence can be provisionally withdrawn or the physical document seized before the case is concluded.

File review and defence

After acceptance of the mandate, the defence can request access to the investigation file. Statements, measurements, medical findings and other evidence are then assessed before deciding whether to remain silent, provide a written response or take another procedural step.

When official correspondence arrives

Preserve every page and the envelope, record the date received and avoid a spontaneous account of events. Submitting an enquiry does not preserve a deadline and does not itself establish representation.
