Driving ban
A motor vehicle may not be driven for a limited period, while the underlying licence generally remains in existence. The precise beginning and end depend on the legal basis, finality of the decision and the individual circumstances.
Driving despite an effective ban can lead to separate criminal proceedings. Dates should therefore be clarified rather than estimated.
Withdrawal of the licence
Withdrawal is a different measure: the entitlement to drive ends and a new licence must later be applied for. A disqualification period is frequently imposed. Measures may arise in criminal proceedings or through the driving-licence authority.
Typical situations
A driving ban or licence consequences may follow allegations involving speed, red lights, distance, alcohol or drugs, leaving an accident scene or dangerous driving. The allegation and the potential licence consequence must be examined together.
Professional consequences
Professional dependence on a licence does not automatically remove a ban. Work processes, realistic alternatives and concrete consequences should be documented. Predictions before reviewing the file and decision would be unreliable.
